Terms of Service

1. Who you are contracting with

The service is operated by Tomas Rimkus IV Nr. 1194686, Viržių g. 15B-1, Lindiniškių k. LT-14181, Vilniaus r. Lithuania(“we”, “us”). Contact: info@ytmark.com. By creating an account or installing the extension you accept these terms.

2. What the service does

YTMark lets you save timestamped moments in YouTube videos, add a note to each one, and return to them later from a synced library. The extension adds a button and markers to the YouTube player; the website hosts your library and your account.

3. Your account

• You need an account, and you must give a working email address.
• You are responsible for keeping your password secure and for activity on your account.
• You must be at least 16 years old.
• One account is for one person. Do not share credentials.

4. Plans and pricing

• Free — bookmarks on one video, with no limit on how many bookmarks you save on it. No card required.
• Pro — unlimited videos and bookmarks, at €4 per month or €36 per year.

Prices are shown on the pricing page and include any applicable VAT unless stated otherwise at checkout.

5. Billing and renewal

• Payments are handled by Stripe. We never receive your card details.
• Subscriptions renew automatically at the end of each period — monthly or yearly, matching the plan you chose — until you cancel.
• We charge the payment method on file at the start of each period. If a payment fails, we may retry and may suspend Pro features until it succeeds.

6. Cancelling

• You can cancel at any time from your account, which opens the billing portal. No email or phone call is required.
• Cancelling stops the next renewal. You keep Pro until the end of the period you have already paid for, and we do not refund the unused remainder of that period except where section 7 applies.
• Your data is not deleted when you cancel. Everything you saved stays readable on the free plan; you simply cannot add videos beyond the free limit until you subscribe again.

7. Right of withdrawal and refunds

As a consumer in the EU or EEA you have 14 days from the start of a subscription to withdraw from it and receive a refund, without giving a reason.

Because this is a digital service supplied immediately, when you subscribe you are asked to request immediate access and to acknowledge that you lose the right of withdrawal once the service has been fully performed. Where you have used Pro during those 14 days, we may reduce the refund in proportion to what you have used.

To withdraw, email info@ytmark.com within 14 days. We refund to the original payment method within 14 days of being notified.

Outside that window, subscription fees are non-refundable. We may still issue a refund at our discretion — for example if the service was unavailable for a prolonged period, or you were charged in error. Nothing here limits your statutory rights.

8. Price changes

We may change prices. We will give you at least 30 days' notice by email before a change affects your renewal, and you may cancel before it takes effect. Changes never apply to a period you have already paid for.

9. Your content

Your notes and the frames you capture remain yours. You grant us only the permission needed to host, store and display them back to you. We do not use your content to train models, and we do not make it public.

10. Acceptable use

You agree not to:

• break the law, or infringe anyone's rights, with the service;
• attempt to access another user's data;
• resell, redistribute or provide the service to third parties as your own;
• use automated means to place unreasonable load on the service, or circumvent plan limits.

11. Relationship to YouTube

YTMark is an independent product. It is not affiliated with, endorsed by or sponsored by YouTube or Google. Your use of YouTube remains governed by YouTube's own terms, and you are responsible for complying with them. Frames you capture are for your own personal reference; the underlying video remains the property of its rights holder.

12. Availability

We work to keep the service running but do not promise uninterrupted availability. We may change or discontinue features. If we discontinue the service entirely, we will give reasonable notice and a way to export your data, and refund any period paid for beyond the shutdown date.

13. Liability

The service is provided as is. To the extent the law allows, we are not liable for indirect or consequential loss, or for lost data or profits. Our total liability in any 12-month period is limited to what you paid us in that period. Nothing excludes liability for death, personal injury, fraud, or anything else that cannot lawfully be excluded — including your statutory rights as a consumer.

14. Suspension and termination

You may close your account at any time by emailing info@ytmark.com, and we will delete it and its contents. We may suspend or close an account that breaches these terms, and will tell you why unless prevented by law. If we close your account without cause, we refund the unused part of the period you have paid for.

15. Changes to these terms

We may update these terms. For material changes we will give at least 30 days' notice by email, and continuing to use the service after that means you accept them. If you do not, you may cancel.

16. Governing law and disputes

These terms are governed by the law of [COUNTRY OF ESTABLISHMENT], without removing the protection of mandatory consumer law in your own country of residence. Disputes go to the competent courts there, and as a consumer you may also bring a claim in your own country.
